What recourse do Pakistan's 'civilian drone victims' have?

In 2010, after three US Hellfire missiles killed his brother and his 18-year-old son, Karim Khan approached a Pakistani lawyer to help him.

Mr. Khan?s son Zainullah Khan and his brother Asif Iqbal both worked at schools in the region. Zainullah worked as a guard at a girls' school, and Asif worked as an English teacher in an area where both girls? schools and schools that teach English are vulnerable to attacks by militants. Khan told the lawyer that both had chosen their jobs because they believed in the importance of education for girls.

?Karim called his son and brother ?civilian targets,? ? says Shehzad Akbar, the Pakistani lawyer attempting to take Khan?s case, along with 82 other families who claim to be victims of drone attacks, to Islamabad.

It?s a difficult task, made more difficult because the more than 3 million residents in Pakistan's Federally Administered Tribal Areas (FATA) have no access to legal recourse.

?Tribal areas are officially a part of Pakistan ? and their residents are formally citizens of this country. But they have no access to Pakistani or international courts, and therefore no legal redress for losses incurred because of US-led drone strikes,? says Mr. Akbar.

Allegations of large numbers of civilian deaths have haunted the drone effort in Pakistan since its inception under President George W. Bush. Under the Obama administration, drone strikes have been at the core of the US strategy aimed at rooting out the Taliban and Al Qaeda from Pakistan's tribal areas, where militants have taken refuge to launch attacks in Afghanistan.

According to a report by Stanford, New York, and Columbia universities, the best available information from the Bureau of Investigative Journalism suggests that of the 2,500 to 3,000 people who have been killed since the first known drone strike in June 2004, anywhere between 450 and 881 were civilians, and another 1,300 people were injured. Those numbers are considered controversial because they rely on media accounts that often depend on the Pakistani government for information (reporters are not allowed free access to the tribal areas).

But Akbar holds up the 82 families hailing from North Waziristan as examples of the numerous nonmilitants who have lost their lives in drone operations ? even as the Obama administration claims that the numbers are much lower and that civilian drone deaths have been rare since 2010.

THE LEGAL OPTIONS

According to Akbar, civilians who claim to be victims of drone attacks have two options: either they can file charges against the CIA and the US government, or they can bring a case to the Pakistani authorities.

If it becomes provable that the US and Pakistan are not collaborating on the strikes, the general consensus in international law would be that US drone strikes are illegal, since there are "no UN resolutions, and the Americans have not declared war," says Akbar, regarding the first option.

But while the Pakistani government has verbally criticized drone strikes as an infringement on the country?s sovereignty, security agencies have shared intelligence with the US, and even allegedly allowed the US to operate drones from Shamsi Airfield in Pakistan until April 2011.

The CIA sends a regular monthly fax to Pakistan's Inter-Services Intelligence (ISI). Until the May 2011 US Navy Seal raid that killed Osama bin Laden, the ISI would acknowledge receipt in a return fax. Their new no-answer policy is seen as continued ?tacit consent? with a ?'we're upset with you'? note attached, reports The Wall Street Journal.

And as for the second option: Though FATA is run differently than the rest of Pakistan, ?under the Constitution FATA is a part of Pakistan ? so its citizens have the same rights as any other Pakistani, including the right to life,? he says, adding that this is an opening to help civilian victims in the area.

But assuming Pakistan could prove it had no part in the drone attacks and the government were to acknowledge its responsibilities under the constitution, it could bring this case to the International Court of Justice in The Hague, says Akbar. ?States, not individuals like the drone victims, can bring cases to the ICJ,? says Akbar.

COLONIAL-ERA LAWS

Khalid Aziz, who has spent 30 years as a government official in Pakistan's northern Khyber-Pakhtunkhwa Province, says that won?t happen anytime soon, as Islamabad has yet to reform colonial-era laws that marginalize its tribal areas.

?Laws passed in Pakistan's National Assembly are not applicable in FATA until the president extends them to the area,? says Mr. Aziz.

Instead, FATA continues to be governed by the Frontier Crimes Regulation, a set of colonial-era laws that were implemented by the British in the 1800s. The British implemented the laws to keep FATA as a buffer zone that held off a fast-expanding czarist Russia and the Pakhtuns in Afghanistan. The FCR has historically allowed ruling powers to carry out collective punishments. And residents of FATA have had no right to appeal detention, no right to legal representation, and no right to present reasoned evidence.

According to Mian Muhammad Ajmal, a former justice of the Supreme Court who spearheaded a committee to reform the FCR, it was not until the summer of 2010 that the government finally began to take action on his 2006 report. But experts say that it will take time to roll out the report's recommendations in FATA. And Mr. Ajmal admits that a reform of the law is different from its complete repeal.

?I still had to work within the confines of the FCR,? said Ajmal in an interview with the Monitor last year.

The former Prime Minister Syed Yousuf Raza Gilani announced that he would repeal the FCR in 2008 but the current government ? which he used to head ? has not made any progress on the case since.

Wall St Week Ahead: Obama's shoes hard to fill, even for himself

NEW YORK (Reuters) - Regardless of the results of Tuesday's U.S. presidential election, the next four years will be a tough act to follow from Wall Street's vantage point.

The benchmark Standard & Poor's 500 Index <.spx><.inx> has rallied 66 percent since President Barack Obama took office - one of the most impressive runs ever for stocks under a single president. Admittedly, the timing of his inauguration - just before the market hit a nadir in March 2009 - is part of the reason.

The national polls show a tight race between Obama and his challenger, Republican candidate Mitt Romney, but leaning toward a win by the president.

"The market might like the fact of an Obama win since it would mean less uncertainty," said Ryan Detrick, senior technical strategist at Schaeffer's Investment Research, in Cincinnati.

Strategists have said the market's pattern of late also suggests status quo - an Obama win. A "Romney rally" is a 1-in-3 possibility, taken betting site InTrade's odds of an Obama win at about 67 percent right now. Other prognosticators put his chances of re-election even higher.

The most recent Reuters/Ipsos tracking poll shows both candidates garnering 46 percent of the vote - but polling averages show Obama with small but critical leads in swing states Ohio, Virginia and Iowa.

There's a conventional line that says a victory by longtime businessman Romney would be better for the equity market, given his predilection for fewer regulations and lower corporate tax rates. Still, any move in the market, no matter the outcome, is likely to be limited.

"I think the market has priced in an Obama victory, but no matter what, any knee-jerk reaction after the election will unwind over the next few days," said Joseph Tanious, a global market strategist at J.P. Morgan Funds, in New York.

"The fiscal cliff is also on everyone's mind, but that will really take hold after the election, since the winner could indicate what happens."

Strategists at LPL Financial have been tracking two baskets of stocks to judge whether the market believes Obama or his challenger Romney will emerge with a win. The "Obama" stocks include health care facilities companies, food and staples, utilities, construction companies and homebuilders. The "Romney" stocks include financials, coal stocks, oil and gas drillers, telecom, and specialty retail names.

The Obama index peaked in early October, before the first debate, largely seen as being won by Romney. Yet in terms of "relative strength," the index still modestly favors the president.

CHANGE AT THE FED?

The move in the market during Obama's administration was in part due to timing as the U.S. economy started to recover from the deepest recession since the Great Depression.

The U.S. Federal Reserve has used three rounds of asset purchases, one of which is under way, as a way to keep interest rates low and stimulate the economy as the recovery from the 2007-2009 recession has been painfully slow.

Romney has criticized the Fed's policy and is seen replacing Chairman Ben Bernanke with someone more likely to tighten monetary policy.

"With Romney, we'd expect a little more weakness off the gate. He might want to put a stop to the Fed's stimulus. That's where that uncertainty comes in," Detrick said.

The Fed's current policy stance is seen as helping Obama. Consumer confidence recently rose to a more than 4-year high, and housing prices are rising again. However, unemployment remains at 7.9 percent nationwide, and the lack of good jobs is constraining growth.

LOOKING AHEAD

Regardless of the winner in Tuesday's election, the market will have one less uncertainty to deal with. It will shift its focus to the roughly $600 billion in mandated spending cuts and tax increases that could kick in next year and send the U.S. economy reeling - if a deal to prevent it is not reached.

The possibility of a new recession - if Congress fails to agree on how to avoid the cliff - has many market participants counting on resolution, with the election as a variable in terms of when any legislation will pass - not if it will happen.

The end result in both an Obama or a Romney presidency would be a deal. But the status quo would probably mean a more protracted solution and market volatility, according to Brian Jacobsen, chief portfolio strategist at Wells Fargo Funds Management, in Menomonee Falls, Wisconsin.

"From an investing standpoint, what I care more about is the likelihood of getting some sort of deal to avoid the tax increases and spending cuts at the end of the year," he said.

Your Blog&#39;s Single Most Important Task

? drum roll please? Your website?s most important task is to BUILD A LIST OF SUBSCRIBERS!

For many of you who are new to the online world of doing business, or maybe you?ve been around for a bit without really paying attention to this, let me explain some of the reasoning behind this so that you will consider adding to your online marketing strategy toolkit.

When you have a brick and mortar store, you have the opportunity to immediately build a relationship with everyone that enters your store. You can greet them, offer to help them with selections, even strike up a conversation. All these actions build rapport and relationships and strengthens your customer loyalty. I much rather do business at a place I feel I can trust and where the atmosphere is friendly and courteous, particularly if they remember me, than somewhere I walk into and the staff is disengaged, disinterested and could care less if you were there or not (yes, that happens). You can, as the store owner, even request that your customers jot down their name to receive updates from you. Since this is a face to face interaction, most customers will say yes, even out of sheer pressure to be kind.

Now, enter your online website or blog: you have NO IDEA who has stopped by your blog AT ALL. Who really liked your site so you can follow up or who spent time looking through your wares or posts. Now, I KNOW we have analytics software (which we will talk about later, like Google analytics) that can give you pretty accurate idea of the number of visitors you had, who visited which page, and even how long they stayed. You can even track it down to the IP address they visited from if you so care to do that. However, unless that visitor specifically enters their email or contact information, you have NO IDEA who they are or how to follow up. And even if you hired someone to track down the IP, #1 that would be spam (and I am sure illegal), and #2 it would be a very expensive process to implement.

But back to my original thought: Why Build A List And How

1- Building a list allows you to capture the contact information of those visitors who visit your site and would like to hear back from you again <?that?s always a good thing

2- Building a list gives you ?permission? to communicate with your subscribers. Now, here is where it gets a little not so black and white. If you abuse that list and start sending them products they can buy, sales promotions and little or no information that is of any value to them, they will simply unsubscribe. Not only that, but they can also report you as a spammer and eventually your email IP will just get automatically blocked.

3- The money is in the follow up! If you have no one to follow up with, the chances they will remember your site, how they found you or what you offered is slim to none. And even if you send an email and the percentage that responds is small, with time, that percentage will increase and also your list will grow. The larger your list, the better your response will be (as long as your content is ethical, of course).

Now, don?t let that scare you. Website owners who use List Building for good (and not for evil) end up enjoying a very nice loyal relationship with their customers, as well as a financial benefit as we all know that people will buy things from those we trust and like.

How to build a list

In this post I will cover what company to use to build a list. There are software tools available online that helps us manage this task for a very affordable price. It will manage your opt in forms, the emails we may want to send to our subscribers, and even manage for us those who simply want to unsubscribe (which keeps you legal online). There are many companies that offer this service and most at comparable prices. I personally have been using aWeber for many, many years because it is robust, reliable, and scalable. It works nicely with your blog widgets to insert opt-in forms and I rather like their training videos on how to use the system. However as with anything new, it will require a little patience to set up so if you have a young teenager around or someone more techy, let THEM do it for you . I will share with you in a nutshell what you do at aWeber to set up your list:

1- You will create a ?list? and give it a name: mybloglist

2- You will create a ?form? to capture the contact details you want to get: the less the better. I recommend name and email

3- You will create a ?message? or series of messages that you want to send after people opt-in. For sure a welcome message including whatever incentive you may have offered to your subscriber for optin in. I used to set up a series of emails, but then it was cumbersome to send fresh emails without doubling up on emails to the same subscriber. So I only send out a welcome email, and then I send the rest whenever I post or have something to share with my list. I do not bombard my list daily, nor do I use my emails to just sell things without rhyme or reason. I suggest you stick to a similar ethical and logical guideline as well.

4- Once you have these basic steps set up, you will then want to grab the form code from aWeber and insert it via a widget into your blog, above the fold line (so the area that users see before they have to scroll down).

That sounds like a bit of a task but if you take sometime to watch their instructional videos, it will be a piece of cake. And you will be able to create as many lists as you need for different marketing initiatives throughout your site. Growth prospects in Russia? are "significantly impeded by uncertainty surrounding the European debt crisis worries, with investors clearly focusing on prime property and risk avoidance," the Voice of Russia reports.

"Along with this trend, the volume of transactions on the commercial real estate market in the UK and Germany this year far exceeds that of other European states."

The Voice of Russia concedes? "the country's office space segment can hardly be called a 'safe haven' due to its ever-present cloud of volatility. At times of economic instability, foreign companies strive to shed all non-core operations, making it unrealistic to expect any sizable expansion of their presence in the country."

The Voice of Russia cites CBRE data that show in 2012 only 20% of investments in Russian commercial real estate market came from abroad, while 80% has a domestic origin.

Valentin Gavrilov, research director at CBRE Russia, told the Voice of Russia by? phone, "The main problems are volatility and lack of investment grade assets in Russia currently. One emerging trend that we see is related to foreign investors' readiness to enter projects on early stages of construction. They are trying to develop high quality properties themselves, rather than search for completed assets."

Gavrilov added, "The process allows us to speculate about a transition that is presently happening in this segment. As a result, foreign players become more accustomed to building high grade objects themselves with the aim to either sell them later on, or keep them for investment purposes."

The Voice of Russia states that earlier this year, Knight Frank concluded heavier involvement of foreign players in the development of office premises in Russia has the potential of resolving the most pressing issue for the segment -lack of supply, especially of high quality assets.

RALEIGH, N.C. ? Physicists racing to detect the mysterious substance known as dark matter are thinking outside the box by looking inside the cell. A new proposal for tracking dark matter particles relies on strands of DNA.

All the ordinary stuff in the universe, from the atoms in people to the hot plasma in stars, makes up only about 5 percent of the universe?s mass and energy. Nearly one-quarter of the universe is composed of dark matter. (The rest is an even more puzzling entity known as dark energy.) Though several experiments claim to have detected dark matter, the results don?t agree and aren?t definitive.

Katherine Freese, a theoretical physicist at the University of Michigan in Ann Arbor, proposed October 28 at the New Horizons in Science meeting that a new kind of DNA-based detector could not only spot a leading candidate for dark matter, called WIMPs, but could also determine incoming particles? direction of flight. The proposal also appeared online earlier this year at arXiv.org.

?It?s a very smart way to apply technology developed from biology to a fundamental particle physics problem,? says Jocelyn Monroe, a dark matter physicist at MIT and the University of London.

A halo of WIMPs, short for weakly interacting massive particles, is thought to encircle the galaxy. As the sun orbits the galaxy?s center, it should encounter a ?wind? of WIMPs from the direction of the constellation Cygnus. At any point on Earth, such a wind should strengthen and weaken daily as the planet rotates.

Freese and her colleagues? proposed detector, which would be sensitive to these fluctuations, consists of a stack of thin gold sheets with single-stranded pieces of DNA hanging from them. When a WIMP smacked into the nucleus of a gold atom, the nucleus would whiz off, cutting through the DNA at specific locations in the strands.?

Scientists would then collect and sequence the DNA to reconstruct the path traveled by the nucleus, and by extrapolation, that of the WIMP. If the detector spotted the daily fluctuation and the particles? paths proved consistent with the WIMP wind?s direction, it would be compelling evidence that the signals came from dark matter.

?The advantage of these detectors is that the difference between DNA bases is a nanometer, so it?s much better resolution,? says Freese ? about a thousand times better than current detectors.

The device could be a fraction of existing detectors? size, as well as cheaper.

Still, the technique has yet to be demonstrated, says Joel Schnur, a biomolecular scientist at George Mason University in Fairfax, Va. ?What is the real sensitivity to cleavage of DNA? How many particles will come down over time? And, can it detect them?? he asks.

If the project goes forward, Freese and colleagues could begin to answer some of these questions.
