President Obama Praises Supreme Court Health Care Ruling; Celebrities Tweet Reactions


After the U.S. Supreme Court upheld Obamacare on Thursday, the President who fought and sacrificed for the controversial law praised the 5-4 ruling.

While the court placed limitations on Congress' power to regulate commerce and the U.S. government's ability to restrict state funds, the law stood.

The survival of the Patient Protection and Affordable Care Act (PPACA) - pejoratively or affectionately called Obamacare - signaled a major victory for Barack Obama.

"Today's decision was a victory for people all over this country whose lives are more secure because of this law," Obama said in a televised statement.

"I know the debate over this law has been divisive," he added. "It should be pretty clear that I didn't do this because it was good politics."

"I did it because I believe it is good for the country."

Obama encouraged on his Twitter account for Americans to share what the Supreme Court ruling means to them and some celebrities did just that.

Japan whistleblower wins in Supreme Court

Japan's Supreme Court has ruled in favor of a whistleblower for the first time in a case that highlights the harsh treatment outspoken employees have endured in a nation that zealously values loyalty and conformity.

Despite being a good salesman with experience in the United States, Masaharu Hamada, 51, was demoted at Olympus Corp., forced to take rudimentary tests and ignored by colleagues, in what he alleged was reprisal for raising the issue of supplier complaints.

He received a notice Saturday from this nation's highest court, dated Thursday, dismissing the appeal by Tokyo-based camera and medical equipment maker Olympus of a 2010 lower court decision. It sealed the victory of the little "salaryman" against a giant of Japan Inc.

"We need a society where honest hard-working people don't lose out," Hamada told The Associated Press. "This is about justice and human rights."

Hamada's story highlights how workers labeled as misbehaving are punished in Japan, where major companies like Olympus offer lifetime employment, although they more freely fire contract and part-time workers.

That means employees like Hamada become targets of cruel harassment designed to silence them or make them quit. Hamada was nearly driven to breakdown during his five-year battle.

Japan is behind some Western nations in protecting whistleblowers. A law to protect them was enacted only in 2006, and critics say it is inadequate because it does not penalize companies that punish whistleblowers. To pursue legal action, whistleblowers can't quit as the law only applies to employees.

Only a handful of whistleblower has come forward in Japan in the past few decades. When they do, they are treated as outcasts, sometimes being told to sit in closet-sized offices or to mow the lawn. Sometimes even their children become victims of discrimination. So abhorred is the employee who dares to question the company.

Hamada sued Olympus in 2008, saying he was punished for relaying a supplier's complaint that its best employees were being lured away by Olympus. Olympus said he was merely transferred, not demoted.

His case is considered a whistleblowing case in Japan because he went first to his bosses and then to the company compliance unit, trying to raise questions about the professional behavior of colleagues for the public good, and, as the Supreme Court found, was punished unfairly in retribution.

Last year, the Tokyo High Court reversed an earlier district court decision and ordered Olympus to pay Hamada 2.2 million yen ($28,000) in damages for the transfer. Olympus had appealed.

Olympus was not immediately available for comment Saturday. In the past, it has called the court rulings favoring Hamada "regrettable."

Olympus has been targeted recently by another high-profile whistleblower, Briton Michael Woodford, the former chief executive.

Woodford was fired in October after he blew the whistle on dubious accounting at Olympus. The company later acknowledged it hid 117.7 billion yen ($1.5 billion) in investment losses dating back to the 1990s. Three former Olympus executives, including the ex-chairman, were arrested earlier this year on suspicion of orchestrating the accounting cover-up.

Woodford has become a hero in Japan. Three weeks ago, Woodford won a 10 million pound (1.2 billion yen, $15.4 million) settlement from Olympus in a British court. He had sued alleging unlawful dismissal and discrimination as he was not given the same treatment as a Japanese employee.

How Hamada will be treated at Olympus on Monday remains unclear.

He plans to show up at work at 8:45 a.m. as usual, wearing his company color, blue, as he is confident he is an upstanding "Olympus-man."

Hamada said he would like to be transferred to the corporate compliance division, given the serious problems that have surfaced with Woodford's case and the knowledge he has gained about proper management through his court battle.

"I would like to work for the true revival of Olympus, where dedicated employees can work and feel joy, in a nurturing environment, and be proud," said Hamada.

5 Reasons Why Mobile Gaming is Lame | TechnoBuffalo

I write about games on the Internet. More specifically, I write about games on a site centered around the mobile and tech industry. I?m a fan of both worlds, but I?m a gaming writer by trade. Being here?means I get to hear all these mobile gamers yelling about how awesome their platform is. Well, guess what. It isn?t. Why?

I?ve come up with five reasons.

Ready the pitchforks. I?ll be in my bunker.

Where are the buttons?

Unless you?re rocking one of the significantly underselling Xperia Play models, your phone is devoid of physical buttons meant for gaming. This single hurdle is the one mobile gaming needs to overcome in order to even stand a chance at wooing the crowd of dedicated gamers.

Without physical buttons, we don?t care. The leading problem within that sentiment is the concept of virtual joysticks. These things are atrocious. Even the best designed virtual nubs are often shoddy examples of strong control.

If a game requires players to virtually move their character, it requires some iteration of a fake joystick or d-pad. Why do you think auto-runners and constantly moving titles are so popular? Because virtual joysticks are crap.

Knock-offs and clones.

The best-selling games in mobile marketplaces are knock-offs and clones of Angry Birds,?Temple Run, Cut the Rope?and Fruit Ninja. It?s like wannabe developers see how successful these games are, and then they set out to make near-carbon copies of their own.

That?s lead to a platform rife with unoriginal experiences.

The sad part, of course, is that these clones rise to the top of the gaming pile for mobile users. That leaves the original or unique games at the bottom of the barrel, where they?ll sit until they?re tossed up on Free-App-A-Day for the world to see.

In-game currency.

You say your app is free? Great, let me step right up and take a look at what it has to offer!

Oh, by ?free? you meant ?download this, play it for five minutes and then encounter a gaming roadblock that requires the purchase of in-game currency to continue.?

Mobile games have ripped a page out of the social gaming model with this one, folks. Like any good drug dealer, they offer up the first taste for absolutely no money down. Once you want to get into the experience completely, you?ll be asked to shell out dough at a constant clip. You want more colors for your Draw Something?canvas? Spend some money. You want to add another floor to your Tiny Tower?right this second? Buy some in-game bucks.

Even better? It?s not like this problem is relegated to just the ?free? games. It spreads to the $0.99 titles as well. You?re out of spin tokens; why not buy some more with you?re real money in order to take a shot of winning some of our fake money?

Senseless reviews.

We?ve all seen ?em. On every platform with a review system, you?ve got users who have absolutely no idea what they?re doing when they rate a product and provide a quick write-up.

You hear about mobile games, essentially, through a handful of channels: word of mouth, top selling lists, marketplace feature slots and user reviews. User reviews, unfortunately, are absolutely garbage.

This game doesn?t have an icon?compatible?with retina display? 1 star!

I played it for five minutes while waiting for a bus. 5 stars!

Want a real quote? Fine. From Leafy18bones on the App Store in regards to the actually successful Hide the Fart:

Anyone can develop and release applications. Like, anyone. And the companies in charge of monitoring the apps and applying ?vigorous? quality control standards are faced with a constant flood of work that they can?t keep up with.

What does that mean for gamers? Scams come constantly. Let?s look at one rather popular example that we actually wrote an article about earlier this year.

Do Not Download Pok?mon Yellow from the App Store!

?Okay, here?s the thing: this application is a scam. It is not a legitimate copy of any version of?Pok?mon. In fact, this illegitimate ?game? doesn?t even load beyond the opening title screen. It?s a fake, it?s a sham and, as our good Mon Calamari friend above frequently tells us, ?it?s a trap!?

Buy it and you may as well have tossed 99 cents into a storm drain and walked away into the sunset?

These things get released into the world of mobile gaming daily.


There, I said it. Now let?s stop talking about mobile gaming like it?s bringing death to classic formats. It?s not. It?s a sideshow, a break, a tourist trap, a gimmick and a slap in the face.

Flu immunity is affected by how many viruses actually cause the infection

ScienceDaily (June 28, 2012) ? Not only does the type of flu virus affect a patient's outcome, but a new research report appearing in the Journal of Leukocyte Biology suggests that the number of viruses involved in the initial infection may be important too. Scientists from Canada found that when mice were infected by relatively high concentrations of the flu virus, they not only developed immunity against the virus that infected them, but this also promoted the generation of a type of immune cell in the lungs poised to rapidly react against infections with other strains of the flu, as well. Mice that were infected with a relatively low concentration of the virus developed weaker immunity against the strain that infected them, did not build up this crucial population of immune cells in the lungs, and showed only delayed immunity toward other flu strains.

This discovery could pave the way for new prophylactic strategies to fight flu infections and provides a novel basis for vaccine design.

"Hopefully, the findings of our study will help to develop better vaccine preparations that will be more effective in inducing protective cellular immunity to fight against infectious pathogens such as bacteria, viruses and fungi," said Martin V. Richter, Ph.D., the lead researcher involved in the work from the Department of Medicine at the Universit? de Sherbrooke and Centre de Recherche Clinique ?tienne-Le Bel in Qu?bec, Canada.

To make this discovery, scientists infected two groups of mice with two different infectious doses of influenza A (H3N2) and analyzed several aspects of inflammation and immunity during the initial infection as well as during reinfection with a different strain of virus. The first group was infected with a low dose of the virus whereas the second group was infected with a high dose of the same virus. Mice infected with the high dose showed increased morbidity, a greater degree of lung inflammation, but also a greater recruitment of influenza-specific immune cells (CD8+ T cells) into their lungs, and a better generation of long-lived respiratory CD8+ T cells called memory CD8+ T cells. In contrast, the mice infected with the low dose of virus suffered less from primary infection but all of the immune responses were induced to lower levels. Consequently, reinfection of mice, 60 days after primary infection, revealed that mice previously infected with a higher dose showed increased protection due to greater magnitude of the memory CD8+ T cell pool present in their lungs before reinfection. This is the first demonstration that the initial infectious dose has an important impact on the generation of specific types of immune memory cells and on the degree of immune protection against reinfection.

"Recent experience with emerging and mutating strains of influenza virus highlight how very few changes in this virus could lead to a catastrophic flu crisis," said John Wherry, Ph.D., Deputy Editor of the Journal of Leukocyte Biology. "While considerable efforts have been invested in predicting new emerging flu strains for our yearly vaccines, it is impossible to prepare for every possible way the flu can mutate. This new research shows that it may be possible to enhance current vaccines to offer broader protection against different flu strains, known and unknown."

Ruling casts doubt on expanding healthcare for the poor

WASHINGTON (Reuters) - While the Supreme Court upheld a U.S. healthcare overhaul on Thursday, its decision cast doubt on whether the plan to extend health coverage to more than 30 million uninsured people will reach some of the poorest Americans.

In its ruling, the court allows states to opt out of an expansion of Medicaid benefits for low-income earners with household incomes of up to 133 percent of the federal poverty line, or about $30,000. The current Medicaid threshold varies geographically but in 33 states is under the definition of poverty of $22,000 per household.

Government officials in states that opposed President Barack Obama's health law, such as Texas and Virginia, said they were studying the ruling and had yet to decide how to proceed on the Medicaid provision. Wisconsin Governor Scott Walker said the state would not take any action to implement the law, and hoped elections in November would put in power Republican candidates who would repeal it.

Others said they were leaning toward limiting any expansion, a move that could deny insurance to a significant percentage of the estimated 16 million people who would have been newly eligible for Medicaid.

But senior administration officials said they were not at all concerned that states would opt out of the Medicaid expansion, saying that nearly all the states joined Medicaid within a few years of its launch a generation ago despite resistance from some governors.

The administration officials pointed out that the federal government would fund the entire Medicaid expansion in the first three years and 90 percent of it thereafter, calling it a good deal for states.

But the prospect of federal support did not diminish governors' worries about matters close to home.

"An expanded Medicaid program would add almost 400,000 new enrollees and cost the state an estimated $1.7 billion over the next ten years," Mississippi Lieutenant Governor Tate Reeves said in a statement. "Mississippi taxpayers simply cannot afford that cost, so our state is not inclined to drastically expand Medicaid."

Florida Governor Rick Scott said the expansion would be devastating to the state's economy.

"If you look at every government program in the world, they overpromise, they run out of money, they underpay providers and that rations care," he told reporters. "As bad as it is for patients, it's going to be just as bad for taxpayers. We're not going to be able to afford this."

Medicaid is jointly funded by the federal government and state governments and represents the biggest spending item in most state budgets.

Eligibility differs widely from state to state, with some states limiting coverage largely to adults with children and pregnant women while others extend coverage to everyone living near the poverty line.

STATES UNDER PRESSURE

Millions of people turned to Medicaid during the 2007-2009 recession due to job losses and drastic drops in income, pushing spending on the program up by an average of 6.6 percent per year, according to the nonprofit Kaiser Foundation.

Medicaid and similar programs are over budget in 10 states this fiscal year, which for most states ends in two days, according to the National Conference of State Legislatures.

"I don't think there's any doubt that some states will say thank you very much but no thanks. Others will eagerly take the deal," said Dr. Arthur Kellermann of the think tank RAND Health.

Americans with low incomes who do not qualify for Medicaid under their states' policies may now be squeezed by the health law's requirement that every individual purchase healthcare coverage or face a penalty.

"It means lots of folks will be caught in between the mandate to have insurance and the fact they may not be able to afford it," said Billy Tauzin, a former member of the House of Representatives who was an early supporter of healthcare reform as head of the U.S. pharmaceutical industry lobby.

Other experts dismissed the Medicaid decision as minor, saying federal subsidies that would cover 90 percent to 100 percent of the cost would largely guarantee its success. The federal government was expected to spend about $430 billion on the Medicaid expansion over the next decade, according to the nonpartisan Congressional Budget Office.

"The incentives to participate are so strong that most people don't expect any of them to opt out unless they were ideologically driven," said Wharton School health economist Mark Pauly.

Other challenges to implementation remain.

On the political front, the law faces the real possibility of repeal if Republicans win control of the White House and the Senate in the November 6 elections. But political analysts said control of the Senate would have to swing decidedly in Republican favor to ensure the law's elimination.

Regardless of who wins in November, analysts say healthcare reform could also come under pressure from efforts to reduce a ballooning national deficit.

Some say Obama will face renewed Republican efforts to delay implementation of the state insurance exchanges to save money on federal subsidies that are expected to total about $350 billion over 10 years.

NASA CIO: We still use OpenStack ? and Amazon and Microsoft Azure ?

So, NASA continues to use OpenStack?after all.

In a recent?interview, NASA CIO Linda Cureton addressed that question which arose after she wrote?a blog post?singing?the praises of OpenStack rival Amazon EC2 and Microsoft Windows Azure but made no mention of OpenStack, the open source cloud platform that NASA helped bring to life.

OpenStack is backed by Rackspace, Hewlett-Packard, IBM, Red Hat and other tech companies as a counterweight to Amazon?s growing power in cloud computing. The cloud platform is called ?the Linux of the cloud? by proponents, and the ?Unix of the cloud? by detractors who say that because each OpenStack vendor will put its own spin on the platform, it will be a fractured offering at best.

When asked specifically whether NASA uses OpenStack at all any more, Cureton said:

Yes, absolutely. There are pilots going on at several centers. At Ames research center, I think there are two pilots, and there is at least one at Goddard Space Flight Center in Greenbelt, Maryland. And there are a few others across the agency and I think that those pilots will probably bear fruit. It?s too early right now to know exactly what?s happening and how well it?s going, but I think they will see more activity as time goes on.

But, she again stressed that NASA will use whatever technology makes the most sense for any given project, whether it happens to be OpenStack or Amazon or Microsoft or whatever.

The only caveat there, I would say, is that these commercial providers are fiercely competitive and they are really putting a lot of energy and emphasis in their cloud offering. They are recognizing that the federal government is a very big customer and a very important customer, so they are not sitting back and letting things go by. I expect that some may go to OpenStack, maybe there are some features that come up in one of the other providers that might appear more attractive, but the beauty of this, I think, for our environment, is to have a cloud computing strategy for the agency that?s flexible, that is fiercely dedicated to the mission needs and not really sacrificing technology or technology preference for what the mission needs are.

In other words, NASA may have worked with Rackspace to launch OpenStack, but it will be ruthlessly pragmatic in its technology choices going forward.

Obama takes bus tour to connect with average Americans

President Obama will take a break from fancy fundraisers for a two-day bus tour through swing states to try to reach out to average voters.

President Barack?Obama?is ramping up a fresh phase of his re-election bid with a bus tour next week, focusing more on direct engagement with voters and less on ritzy fundraisers.

Obama's?two-day road trip through Pennsylvania and Ohio, two key battleground?states?in the November election, kicks off July 5, a campaign official said. It will be the president's first bus tour of the 2012 campaign.

The bus trip also will coincide with the release of the monthly nationwide jobs report, a key economic indicator that could directly affect the president's re-election prospects. The most recent report, for May, showed a slight uptick in the unemployment rate, raising fears among?Obamaaides of an election-year economic slowdown.

While?Obama?has been running for re-election for months, his efforts thus far have focused largely on hauling in cash from supporters in dozens of fundraising events across the country as his campaign seeks to compete with energized Republican donors. He spent the early part of this week on a two-day, four-state fundraising blitz that brought in more than $5 million.

The president will still headline campaign fundraisers through the fall, but the official said?Obama's?schedule would start to include more of a mix of campaign rallies and other events focused on speaking directly to a wide swath of voters in the?states?Obama?needs most in order to hold the White House.

Further underscoring his strategy shift was his campaign's announcement this week that Jennifer Psaki, a former senior White House aide, was joining the president's re-election team as traveling press secretary.

Ohio and Pennsylvania, with 38 electoral votes between them, are crucial to the president's re-election bid.?Obama?won both?states?in 2008, but Republican rival Mitt Romney is expected to make a strong play for each.

Just over four months from Election Day,?Obama?aides consider Ohio a toss-up but believe Pennsylvania is leaning in the president's favor. Romney took a bus tour of his own through Ohio and Pennsylvania earlier this month.

A new poll by Quinnipiac University shows?Obama?holding a 9-percentage-point lead over Romney in Ohio, and a 6-point lead in Pennsylvania. Both?states?have improved their employment pictures in the past year. Ohio saw its jobless rate drop from 8.8 percent a year ago to 7.3 percent in May; Pennsylvania's rate fell from 8 percent to 7.3 percent in that time.

Obama?has turned to bus tours before when he needed to reconnect with voters. Last summer, after a bruising fight with congressional Republicans that brought the government to the brink of fiscal default, the president hit the road for a Midwestern bus tour aimed at refocusing his presidency on the economic issues affecting the middle class. He followed it up with a fall trip through Virginia and North Carolina.

Rolling through?swing?states?on a campaign bus allows?Obama?to engage in more of the informal, retail-style politics that can be hard to achieve in the highly scripted White House. Between his scheduled events, the president is sure to make surprise visits to restaurants and small businesses or stop to greet voters gathered on the side of the road to watch his motorcade.

Obama's?itinerary for the bus trip was still being finalized, but the official said the president probably would hold events in northern Ohio and western Pennsylvania. The official insisted on anonymity in order to discuss details of the trip before an official announcement from the campaign.

What I've Learned Online ? 5 Important Lessons | Business 2 ...

What i've learned online 5 lessoonsIn last Mondays post I said that I wanted to do a mega post for my 50th birthday which is on Sunday July 1st and asked for suggestions, I had a couple of really good ones and I?ll try to merge them together in this post.

This post will hopefully give you some background about how I got to where I am am today and where I see myself and IM a few years down the line and what I?ve learned along the way? Grab a coffee sit back and enjoy!

When I first started in the IM Business my aim was just to make an income from creating Adsense sites, I quickly realized that that is a pretty medium term business as it takes time to get the income coming in so I started to build sites for others. By spending 4 or 5 hours a day creating websites for $10 a time I was able to quickly earn enough to live on.

It wasn?t high paid work but it generated cash which is what I needed at the time. Once the sites I built for myself started to earn a good income I was able to reduce and finally stop providing services to others. This taught me my first lesson.

Lesson 1.

A solid Internet Marketing Business consists of a Long term plan , a short term plan and a medium term plan?There is no Magic Button

Because I lacked a lot of cash when I started I couldn?t afford to invest in many tools so I had to learn how to do things manually, keyword research, link building etc. because I was able to focus on the jobs I had to do I wasn?t looking for the next big thing, I still talk to people who started out at the same time as me in 2005 and they are still trying to find that magic button. Justin Wheeler used a term last week that sums this syndrome up perfectly ASOD ?Attention Deficit Oooooh Shiny?.

I get emails everyday promoting the next best thing I need to have, If I don?t open them for 2 days then there is something better waiting for me! If you see an email for something you need there and then or within the next 24 hours consider it, if not make do with what you already have.

Lesson 2

Focus on what you have, every cent you spend on a new shiny product is one more cent you need to earn to make a profit?There is no Magic Button

I got quite lucky with the sites I build and was soon earning over $4000 a month with Adsense, and a similar amount with product sales, life was good?Then google slapped me so hard that I woke up in the 18th Century. Overnight they almost killed my niche site business. My income dropped to 10% of what it was. To many of you this sounds familiar but we aren?t talking about Panda or Penguin, this was back in 2006. Google slaps are nothing new to those of us who have been in IM for any length of time. You just need to deal with them and move on.

Lesson 3

Any business that relies on 1 source of traffic for an income is a disaster waiting to happen? There is no Magic Button

I was actually quite lucky as I had suspected that google wouldn?t allow things to remain the way they were so I had diversified and I had started creating products. I learned the basics by working as an Intern for a mad old school Internet marketer who shall remain nameless at this point in time. As a result of what I learned I was able to create my own product and sell 100 or so copies. For a first product that didn?t have the benefit of a marketplace like the Warrior Forums ?WSO?s ? this was a revelation to me and I knew it was what I wanted to do. After that the rest is pretty much the same, I?ve focused on creating useful products that will help people do the stuff that I?ve found I needed.

Lesson 4.

Mastermind Groups and Mentoring can provide a short cut to success but like everything you need to be prepared to work at it and follow instruction? There is no Magic Button

Mistakes

The biggest mistake that I?ve made in my time online was to think I could be successful without building a list, The 2nd biggest mistake was thinking that I needed a big list , Nothing could be further from the truth. With the right kind of list building and the right approach to your list you can make a very good living with a small list. I?ve spent most of the last 6 months reducing a list of around 10,000 to under 3000 and I?d still like to get it lower.

Another mistake I?ve made is not playing to my strengths, until recently i?ve tried to do everything, product creation, marketing, sales copy, getting JV partners etc. This is the wrong way to do things as no one is a master of everything. I?ve recently started to focus on what I do best which is Product creation. The last product I created was marketed by someone else and I just took a percentage of the income, this resulted in one of my most profitable products and it only took me a fraction of the work it normally does.

I am currently working on another product and when it?s complete I will probably look for a partner to market it for me.

Lesson 5

Play to your strengths, and outsource everything else? There is no Magic Button!

The Future

That brings us pretty much up to date so I think that I?ll finish off by talking about what my future plans are;

The first thing I want to focus on for the next few months is to build up my Facebook presence , it?s something that I?ve ignored but I?ve recently seen how powerful it?s been, by the time this post is live I hope to have hired a social media manager.

Sites like Facebook, Pinterest and Google Plus are going to be more important over the coming months and years. I mentioned in a previous post that I?ve managed to reduce my organic traffic from google from over 35% of my total visitors to under 10% which at the same time trebling my traffic by ?dabbling? with social media I would love to remove google search from the equation completely.

I?m not saying that Facebook is any better than google but they are more open about what they want. They want us to pay a small amount to have our posts seen by more people, thats fine by me. If google said they want me to pay $50 a month to rank for a particular keyword then I would be happy to do that.
