When an employee takes FMLA leave because her physician says she?s too sick to work and needs to stay home, it?s natural to assume she?ll follow the doctor?s orders.

But what if you discover that she isn?t?and is instead working for someone else during her leave? Can you terminate her? Of course.

As long as you have a reasonable belief that she?s using FMLA leave for something other than its intended purpose, a court is unlikely to second-guess your disciplinary decision.

Recent case: Jadwiga was a physician in a municipal agency. When she developed ulcers and clinical depression, her doctor certified that she needed FMLA leave and couldn?t do her job.

The certification restricted her to her home and stated that she could ?not work/attend school.?

That didn?t stop Jadwiga from doing work for another city, telecommuting from her home. She was terminated for abusing FMLA leave.

She sued, alleging interference with her FMLA leave rights.

The court threw out her case. It reasoned that she was fired because her employer reasonably believed she was abusing FMLA leave. After all, if she had been ordered to stay home and do no work, working for another city certainly constituted FMLA leave abuse. (Warwas v. City of Plainfield, No. 11-1736, 3rd Cir., 2012)

Final note: Be sure that you investigate all suspected leave abusers, not just employees who take FMLA leave.

McLaren driver Lewis Hamilton has said that he had not been as lucky as Sebastian Vettel of Red Bull Racing to have a dominant car during the year in which he won his world championship title.

Vettel has claimed the championship titles in the preceding two seasons and he entirely dominated during the last one in which he scored 11 grands prix victories. Nonetheless, he asserted that he is still looking forward to perform at his best in the remainder of the season so as to help his team in securing a good position in the constructors? championship.

?For whatever reason it hasn't happened and I'm not going to complain. For the rest of the year now it's just to try and help the team win the Constructors' Championship,? he added.

At present, the 2008 world champion is standing at 4th place in the drivers? championship. Besides, he is ahead of Mark Webber of Red Bull and is behind his main rival, Kimi Raikkonen of Lotus.

Mylan hints at deals to strengthen specialty drugs business

(Reuters) - Mylan Inc raised its full-year earnings forecast, buoyed by rising generic drug sales in North America, and said it could be interested in acquiring specialty drugs to counter an expected slowdown in generic sales growth after 2013.

The expiry of patents on several blockbuster drugs stretches through 2016, but the biggest drugs will have lost their patent protection by next year.

Mylan, one of the world's largest generic drugmakers with more than 1,100 products, has not made a big acquisition since 2007, when it bought Germany's Merck KGaA's generics business for $6.6 billion.

Mylan is looking at acquiring companies that make injectables, topicals and dermatology products, Chief Executive Heather Bresch said on a conference call with analysts.

"I think in 2013 they start slowing down on the North American business and in 2015 they have got a generic EpiPen coming from Teva Pharmaceutical Industries Ltd, and that could be a meaningful impact on earnings," Louise Chen of Guggenheim Securities said.

Mylan has a whole host of drugs, but if they do an acquisition, then people can forecast growth over a couple of years instead of looking at it just on a quarterly basis, Chen added.

The company currently derives about 16 percent of revenue from its specialty drug business.

The generic drugmaker, which has a market value of $9.72 billion, is already involved in developing respiratory and biologics products. It also has a branded injectable anti-allergen product called EpiPen.

Mylan has marketable securities and cash and cash equivalents of $365.9 million as at September 30.

RAISES FULL-YEAR FORECAST

Mylan raised its full-year 2012 adjusted earnings forecast to between $2.50 and $2.60 per share, up from $2.45 to $2.55.

Analysts expect 2012 earnings of $2.52 per share, according to Thomson Reuters I/B/E/S.

The company posted an adjusted third-quarter profit of 83 cents per share, beating Wall Street estimates of 77 cents per share, according to Thomson Reuters I/B/E/S.

Total revenue rose nearly 15 percent to $1.81 billion, but fell short of analysts' expectations of $1.85 billion.

The company's generic revenue jumped 10 percent to $1.5 billion in the third quarter, as the expiry of patents on several blockbuster drugs expand the market for generics.

Sales in the Europe, Middle East and Africa (EMEA) region fell 7.2 percent to $325.6 million in the third quarter, hurt by price cuts in Europe and foreign exchange rate fluctuations.

Excluding the effects of a strengthening U.S. dollar, sales in the EMEA region rose 3 percent, helped by sales growth in France and Italy.

"Many of our European markets realized increased sales, an encouraging sign that the region may finally be turning a corner," CEO Bresch said on the call.

Susquehanna Financial Group analyst Gary Nachman said it was encouraging to see growth in Mylan's non-U.S. revenue.

"That has been something people have been nervous about. It looks like at least Europe has stabilized and is now starting to grow," Nachman said.

Sales in North America rose 19.2 percent to $837 million. Research and development spending jumped 53 percent in the quarter.

Shares of Canonsburg, Pennsylvania-based Mylan were up about 4 percent at $24.88 in afternoon trade on the Nasdaq. They touched a year-high of $24.94 earlier in the day.

Developing games ain?t cheap. Grand Theft Auto, Street Fighter, Assassin?s Creed needed enough funds to buy me several island getaways on which I could build a fortress to house my collection of Batman and Iron Man armours with I?m drifting again! You know what else those games have in common? They didn?t cost anywhere near as much to produce as Halo 4 did.

Talking to Polygon, Microsoft Studios head Phil Spencer described Halo as a $3 billion franchise, and as the ?most important entertainment product in the company?. When pressed for how much it cost to create Halo 4, hey big Spencer remained tight-lipped, saying only that ?nothing?s even close.?

To put that into perspective, Halo 3 had a development budget of $60 million, and made over $300 million in first week global sales for Microsoft, back in 2007. If i had to take a stab at the budget for Halo 4 however, I wouldn?t be surprised to hear if around $80 ? $100 million had been spent on creating the game.

Of course, cash doesn?t equal quality, and there are plenty of games out there to prove this, such as The Witcher 2, which managed to deliver blockbuster entertainment for around $10 million.

But either way you slice it, that?s still a whole lot of green. Still, even if you aren?t a fan of Halo or a diehard Playstation fanatic, it?s pretty damn hard to deny that the money was well spent on the visuals for Halo 4. I?m just hoping that a chunk of change made its way into the gameplay as well.

Halo 4 is out on November 6, exclusively for the Ex-Bawks free sixties.

A Masai elder's coming-of-age tale. Sort of.

After two years of invitations, I finally made it to Africa to visit my friend Moses, a Masai elder, at his village in Kenya.

The Masai have a long history of being great warriors, and that first night while sitting around a fire, Moses offered to tell me about hunting lions. This was an honor, as his people also consider themselves to be great storytellers and do not often share such private tales with visitors.

A Masai boy is expected to hunt a lion with only a shield and spear before he is considered to be a man. While he does not have to kill the lion, he must participate in the hunt. Moses was about 13 when he faced this trial, which is an integral part of his culture.

Moses put on a grave face and began to tell about the lion dance that is performed the night before a hunt and how the warriors jump high into the air while moving in a circle to imitate what they will do in the morning. They begin the hunt by driving the lion into a thicket and surrounding it in a wide circle, then slowly advancing until the lion is so threatened that it attacks a warrior. That warrior then throws himself on the ground, covers up with his shield, and hopes his fellow hunters kill the lion with their spears before it kills him.

Moses stared into the fire a long time before continuing, and I thought perhaps he had awakened a bad memory.

Reaching down, he pulled up his bright red shuka (robe) and showed me a long jagged scar on his calf, saying he'd gotten it on his first lion hunt.

I was shocked. I said, "The lion did that to you?"

He leaned forward as if to impart a great secret and said, "No. I was so scared, I speared myself in the leg, and the lion got away!"

With that he threw his head back, giggling uncontrollably. I had received my introduction to Masai humor.

Fly genomes show natural selection and return to Africa

When ancestral humans walked out of Africa tens of thousands of years ago, Drosophila melanogaster fruit flies came along with them. Now the fruit flies, widely used for genetics research, are returning to Africa and establishing new populations alongside flies that never left ? offering new insights into the forces that shape genetic variation.

That's one of the findings from two new papers published this month by researchers at the University of California, Davis, and their colleagues that describe the genomes of almost 200 strains of the tiny flies.

The work reveals strong evidence of pervasive natural selection throughout the D. melanogaster genome, said Charles Langley, professor of genetics in the Department of Evolution and Ecology at UC Davis and an author on both papers. That is in striking contrast with what is known of the human genome, which shows comparatively little evidence of adaptation over the last 100,000 years.

The overall aim of the research is to better understand the forces that shape genetic variation, Langley said. Human geneticists are working to sequence a thousand human genomes to get at the same issue. The knowledge from studying fly genetics has and will help in that effort, he said.

"Most of the theory and statistical methods in human genetics were originally motivated by studies of flies, because they're easier and faster to work with," Langley said. "Model organisms like these play a critical role in developing tools and ideas."

The first paper, published Oct. 1 in the journal Genetics, reports the genomes of 37 strains of Drosophila collected in Raleigh, N.C., and six strains from the sub-Saharan nation of Malawi. The other paper, to be published in Public Library of Science Genetics and currently available online as a preprint, describes the genomes of 139 fly strains covering 22 African and one European population.

Drosophila melanogaster, like humans, originated in Africa, and that's where they show the most genetic diversity ? just as humans do. The flies are thought to have appeared in Europe about 50,000 years ago, along with modern humans. On the way, both humans and flies squeezed through genetic bottlenecks that reduced the diversity in the population. Over generations, different fly strains evolved quite specialized niches ? such as a fondness for colonizing breweries, for example.

But the African fly genomes show that just in the past couple of decades, flies similar to those found in Europe or the U.S. have established populations back in Africa, often in new environments such as urban and industrial developments. For example, where modern breweries and bottled beer have displaced traditional African brewing, "Europeanized" brewery flies have followed.

The spread of those "European" genes is more rapid than if it were occurring by random processes, the researchers write.

"It may be that urbanization and development favor the more 'European' flies," Langley said.

SAN FRANCISCO, Oct. 14, 2012 (Reuters) ? As tablets and smartphones draw more and more users away from PCs, Intel Corp is facing some difficult questions.

Intel, the world's leading chipmaker, is used to being king of the personal computer market, particularly through its historic "Wintel" alliance with Microsoft Corp, which led to breathtakingly high profit margins and an 80 percent market share.

But in the fast-growing and cut-throat mobile world, Intel is struggling - its market share is less than 1 percent of smartphones, trailing Qualcomm Inc, Samsung Electronics Co Ltd, ARM Holdings Plc and others.

That leaves some investors, already concerned about a lackluster global economy, asking if Intel's invincibility has come to an end, and whether its profit and revenue growth potential may become much more ordinary.

When the company reports third-quarter results on Tuesday, one key figure to watch is gross margin, which analysts forecast at 62 percent. While that is still the envy of smaller chipmakers, it has been declining from a record 67.5 percent in late 2010, a trend analysts expect to continue.

"If we're moving to mobile, which is a low-margin business, it's difficult to see where the high-margin business is going to be for Intel," said Michael Yoshikami, chief executive of Destination Wealth Management. "That's why we own Qualcomm and we don't own Intel."

Shares of Intel have fallen about 7 percent over the past year. Qualcomm, a leader in providing "logic chips" or processors for tablets, has gained 12 percent.

It is not all gloom for Intel. Its highly profitable server chip business, now almost a quarter of revenue, is growing quickly as Internet companies like Google Inc and Amazon.com Inc build more "cloud" data centers to offer services to consumers using mobile gadgets.

Shipments of cloud servers are expected to grow at an average annual rate of 31 percent through 2015, much faster than overall server shipments, according to IHS iSuppli.

Pointing to an indirect benefit of mobile computing, Intel estimates that for every 600 new smartphones or 120 new tablets bought by consumers, an additional server is needed.

Still, the 44-year-old founding member of the Silicon Valley technology industry is struggling to find its place in a world moving quickly to mobile gadgets and social networks.

Analysts say emerging markets and business customers will fuel Intel's growth for the next several years but not at the explosive rates it has often enjoyed in the past.

Intel's revenue is forecast to be roughly flat this year with 2011 and to grow 4 percent next year, according to Wall Street estimates compiled by Thomson Reuters I/B/E/S. That compares with 24 percent annual growth in the past two years.

Many technology pundits have declared the end of the PC era since Apple Inc's iPad hit the scene in 2010 and kick-started the market for touchscreen tablets.

Intel was slow to recognize how big a threat tablets would become, with executives describing them as complementary to PCs - a view shared by many others.

Increasingly, people are changing their tune. Global PC shipments are expected by analysts to decline slightly this year, the first annual drop since 2001.

To inject new life into PCs, Intel has been promoting a new category of thin, "Ultrabook" laptops with touch screens enabled by Microsoft Windows. But the Ultrabooks launched so far have been criticized as too expensive, and manufacturers have shipped fewer than expected. Intel declined to comment.

That shortfall was underscored when Intel warned in September of weak demand and cut its own forecast for third-quarter revenue by more than even the most pessimistic analysts expected.

The release of Intel's new Ivy Bridge processor this year was meant to speed up sales of Ultrabooks. But with premium-features like solid-state drives and touch displays, many models went for $1,000 or more - well above the $600-$700 price tag that analysts say is needed to gain traction with consumers.

Pointing to those high prices, IHS iSuppli recently slashed its forecast for 2012 shipments of Ultrabooks from 22 million units to 10.3 million units, with half of those expected in the next three months, coinciding with the launch of Windows 8.

"The only way it's going to work is if the PC world can achieve better economies of scale and get those prices down," said Longbow Research analyst Joanne Feeney.

Determined to protect its profit margins, Intel in the past has suggested it will not reduce chip prices to make Ultrabooks more affordable. Intel's dominance has long allowed it to charge aggressive prices for its processors - unlike many competitors, Intel both designs and manufacturers its own chips.

But even with that advantage, along with technological improvements and growing economies of scale, Intel may be hard pressed to preserve margins as it moves further into mobile, where processors sell for much less, analysts said.

Gross margins on smartphone processors typically work out to 50 percent, according to D.A. Davidson & Co analyst Aalok Shah.

"We believe the post-PC era has arrived," Piper Jaffray analyst Gus Richard wrote in a recent note to investors. "Moreover, $120 Intel CPUs are being replaced by $25 ARM-based CPUs as PCs are being cannibalized by tablets."

To be sure, many analysts say PC sales will pick up once the economy improves. Market research firm IDC said PC shipments fell 8.6 percent in the third quarter, but it expects annual growth in a range of 6.5 percent to 7.5 percent through 2016.

Microsoft also plans to launch a tablet/laptop hybrid using Intel's processors, aimed at corporate customers looking for a device compatible with business software that does not currently run on the iPad or Android tablets.

If nothing else, Intel's depressed share price has made investors like Capital Advisors fund manager Channing Smith take a closer look.

"Obviously the stock is extremely cheap and it has a very attractive dividend yield, but there's a good reason the stock is where it is, and that's mainly because strategically they've really missed out on mobile," Smith said.

A wave of change is sweeping through the construction industry with Mainzeal and Hawkins Construction both setting up new company structures.

Mainzeal chief executive Peter Gomm said the more difficult environment since the onset of the global financial crisis was behind plans for the company to move to a new model for its business.

Mainzeal plans to reconfigure itself and run its business through five completely new companies which it has already incorporated.

Mainzeal is believed to be the biggest asset in the privately owned Richina Group, which is associated with Auckland businessman Richard Yan.

Under its current structure, Mainzeal's operations are consolidated into Mainzeal Property & Construction, which has two 100 per cent subsidiaries, Mainzeal Project Services and Mainzeal Living, which in turn owns a 75 per cent stake in Stonewood Homes.

Mainzeal Property & Construction also owns a 50 per cent stake in MWH Mainzeal Joint Venture, a company heavily involved in the rebuilding of Christchurch.

Under the planned changes, Mainzeal's operations would be consolidated into a new company called Mainzeal Group, which will also have four subsidiary companies, Mainzeal Ltd, Mainzeal Construction, Mainzeal Construction SI and MPC NZ Ltd.

Gomm said the planned changes were designed to make the company more sustainable in the face of changing market conditions.

"We've been looking at our business model for some time. And with the global financial crisis, the world has to recognise it's a different place. Construction's in a different place."

The company's operations would become regionally focused and overheads would be spread over a broader base of businesses, he said.

However, Mainzeal's board still had to approve the changes and Gomm did not expect them to be implemented before next year.

The planned reorganisation follows a similar move completed by Hawkins Construction earlier this year. Like Mainzeal, Hawkins Construction also has a long history and its website proudly proclaims that it's "a company that's been around for more than 60 years."

So people may be surprised to

know that although the business of Hawkins Construction has been around for a long time, the company called Hawkins Construction Ltd has only been around since February.

That's because in February, Hawkins Group incorporated a new company called Hawkins Construction 2012 Ltd.

Then in April, there was a shuffling of ownership of the shares in Hawkins Construction Ltd, the company that had been in existence since 1963.

On April 4, all the shares in Hawkins Construction Ltd were transferred from McConnell Ltd to Hawkins Group Ltd, a company incorporated in December last year.

Then a few hours later on the same day, the same shares were transferred again, from Hawkins Group Ltd to Hawkins Construction Group Ltd, a company that had been incorporated just a few weeks earlier.

Then on May 1, Hawkins Construction Ltd changed its name to Hawkins Construction North Island Ltd and Hawkins Construction 2012 dropped the 2012 from its name and became simply Hawkins Construction Ltd, the two name changes occurring contemporaneously.

This unusual shuffling of names and shareholdings was part of a broader restructuring of the group's affairs, Hawkins Construction executive General manager Dan Ashby said.

Ashby said the changes followed an operational review of the business and were driven by the need to separate its infrastructure division, which had previously been part of the construction company, and by the need to better service its operations in Christchurch.

Like Mainzeal, Hawkins is also heavily involved in the rebuilding of Christchurch, but lately has been more in the news over a financially disastrous project to build a new prison in Australia.

Lawmakers Differ on Congressional Investigation Into Libya

As Congress continues its investigation into the terrorist attack that left four Americans dead in Libya, Democratic lawmakers are accusing the Republican majority in the House of playing politics.

Rep. Elijah Cummings, D-Md., said the congressional investigation that aims to find out how much the Obama administration knew following the attack is ?turning into a witch hunt.?

?We will search the killers down and bring them to justice. The one thing we must not do, though, is ? treat it like political football,? he said on CBS?s Face the Nation on Sunday. ?We have a situation where we rushed to a hearing. We don't have substantial evidence yet.?

Cummings also accused Republicans on the Hill of scheduling the hearing to benefit their nominee for president, Mitt Romney.

?The way we're doing it, I think, is basically based on a campaign schedule, trying to give Romney some talking points,? he said. ?But I don't think that our men who were killed deserve this. I don't think our diplomatic corps deserves this. We can do better.?

But Republicans argued that the administration's reaction following the attack in Libya is worthy of inquiry. Sen. Lindsey Graham, R-S.C., said the administration is either ?misleading or they?re incredibly incompetent,? adding that Libya has become President Obama?s ?Mission Accomplished? moment, a reference to President George W. Bush's handling of Iraq.

?This whole region is about to explode. Al-Qaida is on the march,? he said on the same show. ?The Middle East is falling apart, and they're trying to spin what happened in Libya, because the truth of the matter is, al-Qaida is alive and well and counter-attacking.?

During the vice presidential debate, one of the attacks that Vice President Joe Biden used against Rep. Paul Ryan was an item in the Republican?s budget proposal that Biden claimed would cut money for embassy security. ?The congressman here cut embassy security in his budget by $300 million below what we asked for,? Biden said on Thursday.

However, in defending Ryan, House Oversight Chairman Darrell Issa, R-Calif., said what happened in Libya was not an issue of money, but of security. He claimed that there is plenty of money in a discretionary fund for security. The State Department, he said, ?didn't want the appearance of needing the security.?

?They are making a decision not to put security in because they don't want the presence of security,? he said on CBS, later adding, ?The money was there, they chose not to have those security personnel on the ground in Libya.?

Leap of Faith: 5 Ways Skydiving 120,000 Feet Can Kill You

This article was updated Sunday, Oct. 14, at 10:26 a.m. ET.

After two weather delays due to high winds, Austrian skydiver Felix Baumgartner will attempt a record-breaking jump today (Oct. 14), ascending more than 120,000 feet (36,600 meters) into the atmosphere inside a capsule attached to a helium balloon. Then, with nothing but a pressurized suit and a parachute, Baumgartner will jump out of the capsule and plummet toward Earth, breaking the sound barrier on the way down.

What could go wrong?

Quite a few things, it turns out ? though Baumgartner and his Red Bull-sponsored team say they have considered and prepared for the risks. Here are five of the dangers that Baumgartner faces as he attempts a record-breaking leap.

1. Flat Spin

The problem: In low air pressure, high-altitude skydivers risk going into something called "flat spin." In this position, the body rotates horizontally ? imagine a record spinning on a record player. An uncontrolled flat spin could render Baumgartner unconscious, his blood rushing to his extremities, including his head. There, blood could pool in his eyes, causing temporary blindness. Worse, the force of the spin and the rush of blood to the head could cause massive brain bleeding and clotting, which could easily be fatal.

The prevention: If Baumgartner's spin gets out of a control, a special elongated parachute will deploy to help stabilize his descent.

2. Boiling Blood

The problem: At the edge of space, from which Baumgartner will make his leap, the air pressure is less than 1 percent of that on Earth's surface. Above 63,000 feet (19,200 meters), the lack of pressure can cause air bubbles to form in the blood, a condition referred to as blood boiling. A bubble large enough to stop the blood from flowing in a major artery could be fatal, and sudden decompression can expand and then collapse the lungs. Depressurization can also cause the body to swell in seconds, as occurred in 1960 when Capt. Joseph W. Kittinger Jr. jumped from 102,800 feet (31,133 m). When Kittinger's glove failed to pressurize properly, his hand swelled to twice its size on ?descent. [8 Craziest Skydives Ever]

The prevention: Baumgartner's full-pressure suit and helmet are designed to protect the skydiver as he falls. The team has emergency medical protocols in place should Baumgartner arrive on the ground in crisis.

3. Freezing

The problem: The upper atmosphere is a very cold place. The Red Bull Stratos team estimates Baumgartner will step out of his capsule into temperatures of minus 10 degrees Fahrenheit (minus 23 degrees Celsius). As he plummets, he could experience minus 70 degrees F (minus 56 degrees C) or lower. In such cold air, Baumgartner's body would be unable to maintain a core temperature of 98.6 degrees F (37 degrees C) for long. When body temperature drops to 82 degrees F (28 degrees C), unconsciousness can occur. Death is likely when the body dips below 70 degrees F (21 degrees C).

The prevention: Baumgartner's suit should protect him from temperatures as low as minus 90 F (minus 68 C).

4. Shock Waves

The problem: As Baumgartner's body approaches the speed of sound, he'll be playing with some serious forces. Shock-shock interaction occurs when shock waves, also known as sonic booms, in the air collide, in this case the stratosphere that Baumgartner is descending through. Such forces could buffet Baumgartner and possibly endanger him or his pressurized suit. "[Baumgartner will] be colliding with the gas so fast that it can't flow out of his way because it effectively doesn't know that he's coming," physicist Louis Bloomfield of the University of Virginia, told LiveScience's sister site Life's Little Mysteries.

The prevention: According to the Red Bull Stratos team, the thin air is an advantage in this case. Shock waves are less powerful when the air is less dense.

5. Hitting the ground

The problem: Hitting the ground without slowing down enough from a 120,000-foot fall is a very bad idea. [Watch Skydive Live]

The prevention: Should Baumgartner fall unconscious during his skydive, his emergency parachute will deploy automatically. Unfortunately, he may not be out of the woods in that scenario, as he will be unable to steer his landing or adjust his speed in the final moments of the fall. That could make for a difficult return to Earth.

Federal prosecutors and FBI agents in Washington have launched a new criminal investigation of Illinois Rep. Jesse Jackson, Jr. involving alleged financial improprieties, including possible misuse of funds monitored by Congress, law enforcement sources tell NBC News.

The probe prompted lawyers for Jackson ??who has been on a leave of absence from Congress since June for medical treatment ??to meet with federal prosecutors this week in an attempt to persuade them not to bring charges against the congressman, sources said.

The sources said it was unclear whether Jackson, who has not been seen in his office for months, would be charged before the November election ??a subject that was discussed between Jackson?s lawyers and the prosecutors this week. Jackson?s lawyers urged the prosecutors not to file charges before the election ? but prosecutors refused to make any commitments, the sources familiar with the meeting said.


Either way, the new investigation could ratchet up pressure for Jackson to step aside. Despite his illness ??which his office has said involves his treatment for bipolar disorder ??Jackson is running for re-election, seeking a 10th term. His lawyers did not return email and phone call request for comment.

Frank Watkins, Jackson?s congressional spokesman,?says he has not reached out Jackson and has not spoken to him about the investigation, and that the first he heard of the investigation was when he was contacted by the Chicago Sun Times, which first reported the story. He said he believes Jackson is still in DC.

The sources, confirming the ?account in the Sun-Times, said the new probe is being run out of the U.S. attorney's office in Washington DC. They said it is unrelated to previous allegations that Jackson was part of a scheme to persuade ex-Illinois Gov. Rod Blagojevich? to name him to the Illinois Senate seat of Barack Obama in exchange for $1 million in campaign contributions from a top fundraiser.

The sources did not specify the financial irregularities being investigated. But the Sun-Times said the case involves misuse of funds or an account monitored by Congress. ?It comes weeks after a report that Jackson and his wife, Chicago alderwoman Sandi Jackson, put their Washington DC home on the market for $2.5 million. A campaign spokesman said at first the home was put on the market to pay for medical bills, but the Jackson later took it off the market.?

Jackson, the son of civil rights leader Jesse Jackson Sr.,?stopped working June 10, his staffers revealed two weeks later. He first obtained treatment at a facility in Arizona before transferring to the famed Mayo Clinic in Rochester, Minn., where doctors said he had "depression and gastrointestinal issues."

He left the Mayo Clinic and went back to Washington, D.C. in early September but has not returned to work.?

Ex-Oklahoma State basketball player leaves jail

STILLWATER, Okla. (AP) ? Ex-Oklahoma State basketball player Darrell Williams avoided more time behind bars Friday when a judge gave him a suspended sentence in a sexual assault case in which Williams insisted he was innocent.

Two women accused the 23-year-old of groping them and reaching inside their pants without their consent at a party in December 2010. Williams' attorneys have insisted it was a case of misidentification, and his conviction rested mainly on the testimony of the women, who identified Williams as their attacker after police showed them a photo of the Cowboys basketball team.

Williams faced up to two years in prison after a jury convicted him in July on counts of rape by instrumentation and sexual battery. However, he continued to insist he was innocent and had requested a new trial based on what his attorneys said was new evidence.

Payne County District Judge Phillip Corley denied Williams' request for a new trial but gave him a sentence that allowed him to avoid prison time. Williams received two one-year sentences to be served at the same time. Both were suspended.

Corley also ordered Williams to register as a sex offender.

Defense attorney Cheryl Ramsey said she was "very upset" by the sentence and would appeal. Ramsey said she wants a new trial so Williams can have the opportunity to be found not guilty and have his name cleared.

"We thought that we had proven that the new trial motion should be granted," she said.

Ramsey said she wouldn't let Williams speak with reporters because of the pending appeal.

When asked for a comment before Friday's sentencing, Williams said, "I'm innocent. I didn't do it."

The Illinois native had been in the Payne County Jail since his conviction in July. He left the jail Friday in a car that pulled out of the garage and drove off without Williams speaking to anyone.

While he was in jail awaiting sentencing, several websites and Facebook pages popped up in support of him, along with an online petition urging the judge to suspend his sentence. His family insists Williams, who is black, is innocent ? the victim of misidentification by white women at the party and of racial profiling by a jury of 11 whites and one Asian who were picked from a largely white jury pool.

Supporters packed the courtroom for Williams' sentencing, some wearing black T-shirts that said "Free Darrell 25." Williams' uniform number was 25. On the back, the shirts said, "Innocent, locked up! for 86 days, I am innocent!!!"

Security was tight, with nine uniformed deputies. Williams' mother was there but didn't speak to the media.

Friend Brandi Robertson gathered with other supporters outside the courthouse, awaiting Williams' release.

"Yes, he's out and he's free and that's great, but he has to register as a sex offender," she said. "So my heart is broken for him. He's a good person and was done wrong and I'm very upset about it."

Ramsey tried during the trial to cast doubt on prosecutors' case by describing it as a "he said, she said situation." She noted neither woman suffered cuts or scratches or had torn clothing. Defense attorneys also claim Williams passed two lie-detector tests conducted by a State Bureau of Investigation examiner that were not admitted into evidence.

Meanwhile, one of Williams' accusers criticized people who believe race played a role in Williams' conviction or that she and the other victim had something to gain by coming forward.

"That's ignorance for people to say this is a race thing," she said in an interview with The Associated Press in August. "It's not about race; it's about rape. He raped two girls."

The AP typically does not identify victims of sexual assault.

Coach Travis Ford suspended Williams from the team in February 2011 but testified at Williams' trial that he believed he was innocent. Before his suspension, Williams led the team in rebounding and averaged 7.1 points per game.

Ford and several of Williams' former teammates attended the sentencing hearing. None spoke to reporters.

There were as many as 80 people at the 2010 house party, including some of Williams' teammates ? all of whom wore matching Oklahoma State warm-up suits. The two women heard about the party at a bar and showed up.

The women did not identify Williams as their attacker until three days after the party, when they were shown a photo of the basketball team by Stillwater police. Before that, the women wrote an anonymous letter to police and some media outlets to report what happened.

At trial, one woman said Williams held her against her will and dragged her in a yard. She said the attack happened in the basement of the house and that no one came to her aid.

Obama trumpets rebound of US auto industry - Washington Examiner

WASHINGTON (AP) ? President Barack Obama is hailing the rebound of the U.S. auto industry, pointing to progress since his administration rescued General Motors and Chrysler.

Obama says in his weekly radio and Internet address that auto sales are the highest they've been in more than four years and the industry has created nearly a quarter of a million new jobs.

Obama frequently cites GM and Chrysler as a success story for his campaign. Automakers are large employers in Ohio, one of the key battleground states being contested by Obama and Republican Mitt Romney.

Markwayne Mullin, an Oklahoma Republican running for Congress, says in the GOP address that the Obama administration has pushed regulations that make it difficult for businesses.

He says the economy "doesn't need more meddling ? it needs more certainty."

Sabathia hurls Yankees into ALCS

NY starter goes 9, shuts down Orioles 3-1; disputed call evokes Yanks-O's history

NEW YORK - Yankees-Orioles. Playoffs. Disputed home run to right field. Yankees win.

Sound familiar?

CC Sabathia and his New York teammates saw Nate McLouth's long drive called foul by the slimmest of margins - hello, Jeffrey Maier - and then hung on to beat Baltimore 3-1 Friday in the deciding Game 5 of the AL division series.

With Alex Rodriguez benched, the Yankees advanced to the AL championship series against the Detroit Tigers, starting Saturday night in the Bronx.

"It is still a long way to go," Sabathia said. "I still got hopefully three or four more starts. So the job is not done yet."

Sabathia pitched a four-hitter, wriggling out of a bases-loaded jam in the eighth inning. It was his first complete game in 17 postseason starts, and the first for the Yankees since Roger Clemens did it in 2000.

Yet it was another piece of history that this game evoked.

The Orioles were in a foul mood, stung on a close play in right that echoed what happened across the street at the old Yankee Stadium in the 1996 AL championship opener, on a fly ball that still stirs emotions in Baltimore.

This time, with the Orioles trailing 1-0 in the sixth, McLouth sent a 3-1 pitch deep down the right-field line. Eyes turned to right field umpire Fieldin Culbreth, who demonstrably waved foul with both arms.

Orioles manager Buck Showalter came out to ask for a video review, and most of the umpiring crew went down a tunnel to examine the images. When they ran back onto the field about two minutes later, they didn't make any signal - meaning the original call stood. McLouth struck out on the next pitch, ending the inning.

"I saw it go to the right of the pole," Culbreth said. "There is netting there and it didn't touch the netting. It did not change direction," he added, indicating he did not think the ball grazed the pole.

Added crew chief Brian Gorman: "We saw the same thing on the replay. There was no evidence to overturn the decision."

Showalter? Not sure.

"I couldn't tell. It was real close," he said.

McLouth wondered, too, what the umps would decide.

"It started off fair and it was just hooking a little bit. I thought it was foul just in game speed," McLouth said. "A couple of people mentioned it might've ticked the pole, but he was way closer than I was and I was satisfied after they went down and looked at the replay that it was foul."

Steven Ellis, a fan from the Broad Channel section of Queens, caught the ball with his Yankee cap in the second deck.

"It was foul all the way, never hit the pole," he said.

Ada Cruz, sitting behind Ellis, added: "No way, no way. I watched it and he caught it."

A stadium usher who wouldn't give his name, however, said he saw the ball glance off the pole.

Back in 1996, the 12-year-old Maier reached over the wall above right fielder Tony Tarasco and deflected Derek Jeter's fly ball. Umpire Richie Garcia called it a home run, which tied the score 4-all in the eighth inning, and the Yankees went on to win in the 11th.

"Just watching at home, I promise," Maier texted to The Associated Press after this play.

Sabathia defeated the Orioles for the second time in six days, Raul Ibanez hit a go-ahead single in the fifth off Jason Hammel and Ichiro Suzuki added an RBI double in the sixth.

Curtis Granderson boosted the lead to 3-0 with a second-deck solo homer against Troy Patton in the seventh, and the Yankees advanced following their decision to bench the slumping Rodriguez, their $275 million third baseman.

"He didn't pitch all five, but it certainly felt like it, didn't it?" Showalter said.

Sabathia, who improved to 4-0 in his last eight postseason starts, didn't allow an extra-base hit. He struck out eight and walked two and matched his season high of 121 pitches.

He took a one-hit shutout into the eighth but allowed Matt Wieters' leadoff single and Manny Machado's walk. Mark Reynolds struck out, and Lew Ford - starting at DH in place of Jim Thome - hit an RBI single.

Robert Andino hit a bouncer to the third-base side that Sabathia gloved, but Eric Chavez left third uncovered and Sabathia's throw to second was late, leaving the bases loaded. McLouth struck out on a changeup and Sabathia escaped when J.J. Hardy hit a slow bouncer to shortstop that Jeter, playing on a sore left ankle, charged and scooped elegantly before throwing to first just in time.

Sabathia pitched a 1-2-3 ninth, finishing a 121-pitch effort as Wieters hit a comebacker. The Yankees ran to celebrate on the third-base side of the mound and the Orioles walked off slowly and somberly.

New York doesn't have much time to get ready for the Tigers. Andy Pettitte, the career postseason leader with 19 wins, starts for the Yankees against Doug Fister.

"I came back to hopefully help this club get into this position," Pettitte said.

For Baltimore, which beat Texas in the first AL wild-card playoff, it was a disappointing ending to a renaissance season for the proud franchise. The Orioles went 93-69, finishing behind the Yankees in an AL East race decided on the final night, and ended a streak of 14 consecutive losing seasons.

"It's been about as much fun as I have had in the big leagues watching how they play the game every day, the standard they held themselves to and the way they raised the bar in Baltimore with each other," said Showalter, who has not reached the LCS in 14 major league seasons.

New York won for the 12th time in 23 meetings between the teams in a matchup so close the Yankees outscored the Orioles 106-102. The teams were within one run of each other at the end of 46 of 52 innings in the division series. New York totaled just 16 runs in the five games and Baltimore 10.

A-Rod (2 for 16), Robinson Cano (2 for 22), Nick Swisher (2 for 18) and Granderson (3 for 19) all slumped against Baltimore. The Yankees advanced despite hitting .219 with runners in scoring position (7 for 32) - but Baltimore was 3 for 22 in that situation during the three games in New York.

Slumping Orioles hitter included Wieters (3 for 20), Hardy (3 for 22) and Jones (2 for 23).

With a 5:07 p.m. start on the first chilly night of autumn, there was an unusual sight at Yankee Stadium at the start - large patches of empty seats. And Baltimore fans could be heard chanting "O" during "The Star-Spangled Banner." But the ballpark filled up by the middle innings.

The 37-year-old Rodriguez, hitless in 12 at-bats against right-handed pitchers with nine strikeouts, was a spectator, too, in a decision that could have long-term repercussions for the Yankees, who owe him $114 million over the next five seasons.

Chavez, who replaced A-Rod in the starting lineup, went 0 for 3 with a pair or strikeouts.

Hammel retired his first 12 batters before a single to right leading off the fifth by Teixeira, a star at Baltimore's Mount Saint Joseph High School. With Reynolds playing behind him at first, the slow-footed Teixeira swiped second for just his third stolen base this year.

"I thought we needed a spark," he said.

Ibanez fouled off three pitches, one clipping plate umpire Mike Everitt on the right ear, before singling up the middle just past the glove of Andino's dive at second base. Teixeira scored standing up as Rodriguez, wearing a gray sweat shirt, jumped up and down in the Yankees' dugout.

Jeter walked on a full-count pitch with one out in the sixth, and Suzuki lined a 91 mph fastball off the wall above the 385-foot sign in right-center.

NOTES: The crowd of 47,081 was the smallest for a postseason game at new Yankee Stadium, which opened in 2009.
